1. Overview

These Terms of Service and Privacy Policy (“Terms”) govern your use of myke, a desktop application that includes a virtual audio driver and related software components.

By downloading, installing, activating, or using myke, you agree to these Terms.

If you do not agree, do not install or use the software.

2. What myke Does

myke installs:

• A desktop application, and
• A virtual audio driver that allows myke to appear as a microphone in third-party applications such as Discord, Zoom, streaming software, games, and conferencing platforms.

The virtual audio driver is:

• Installed solely to support myke’s functionality
• Microsoft-signed
• Removed automatically when myke is uninstalled

Installing myke may require administrator privileges in order to install and configure audio driver components.

myke does not monitor, record, or transmit your audio except as necessary for its intended functionality.

3. Licensing & Editions

myke may be offered in multiple editions, including a free edition (“myke Free”) and one or more paid editions (“myke Pro”).

Downloading and installing myke does not grant access to all features. Certain functionality may require a separate license purchase, activation, or online verification.

Paid editions of myke may require:

• Online activation
• Periodic license validation
• Reasonable device or activation limits

Licenses are intended only for use by the purchaser and may not be resold, publicly shared, sublicensed, or transferred except where required by law.

SAMEpg, LLC reserves the right to suspend, revoke, deny, or deactivate licenses obtained fraudulently, used abusively, shared publicly, or used in violation of these Terms.

Features, limitations, pricing, activation policies, and edition availability may change over time.

4. Acceptable Use

You agree to use myke only for lawful purposes and in compliance with all applicable laws and platform terms.

You may not:

• Use myke to violate the rights of others
• Use myke for malicious, deceptive, fraudulent, or harmful activities
• Attempt to bypass licensing, activation, or feature restrictions
• Reverse engineer, modify, redistribute, or resell the software except where permitted by law

5. Updates & Online Services

myke may periodically connect to online services for purposes including:

• License activation and validation
• Software update checks
• Downloading product updates
• Basic operational or support functionality

Some features of myke may require an active internet connection to function properly.

Third-party services and platforms used alongside myke, including communication platforms and hosting providers, are outside the control of SAMEpg, LLC. Availability and compatibility with those services may change at any time.

6. Information We Collect

When you download, activate, purchase, or use myke, we may collect and store information including:

• Your name
• Your email address
• License keys and activation status
• Purchase and subscription information processed through Stripe
• Device identifiers and device names associated with activations
• Activation timestamps
• App version information
• Basic support or diagnostic information related to licensing and product operation
• The date and time of download or activation
• Your consent to these Terms

Payment information is processed securely through Lemon Squeezy (Stripe). SAMEpg, LLC does not directly store full credit card numbers.

This information may be used for:

• License management and validation
• Product updates and support
• Fraud prevention and abuse detection
• Customer communication related to myke
• Basic operational analytics related to licensing and software functionality

7. What We Do Not Do

We do not:

• Sell your personal data
• Share your personal data with third parties for marketing purposes
• Send unsolicited marketing emails
• Monitor or record the content of your microphone input, soundboard usage, or audio activity for advertising purposes

We only use your information in ways reasonably related to operating, improving, licensing, securing, and supporting myke.

8. Emails & Communication

You may receive emails related to:

• Download confirmations
• License purchases and activation
• Important product updates
• Security notices
• Changes to these Terms
• Support or operational communications

You may opt out of non-essential communications at any time.

9. Third-Party Software & Services

myke includes or interacts with third-party software components, services, platforms, and open-source libraries.

These components may be subject to their own licenses, terms, and privacy policies.

SAMEpg, LLC is not responsible for the operation, availability, security, or policies of third-party platforms or services used alongside myke.

10. . Disclaimer & Limitation of Liability

myke may be released as pre-release, beta, early-access, or evolving software.

While reasonable efforts are made to ensure stability, security, and compatibility, myke is provided “as is” and “as available” without warranties of any kind, express or implied.

While serious issues are not expected, SAMEpg, LLC is not liable for:

• Data loss
• System instability
• Hardware or software conflicts
• Service interruptions
• Third-party platform issues
• Lost profits or business interruption
• Any indirect, incidental, consequential, special, or punitive damages arising from the use of myke

You are responsible for ensuring myke is compatible with your system before installing or using it.

To the maximum extent permitted by law, SAMEpg, LLC’s total liability arising from or related to myke shall not exceed the amount you paid for the software, if any.

11. . Ownership & Intellectual Property

myke and all related software, branding, assets, interfaces, and components are owned by SAMEpg, LLC and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use myke in accordance with these Terms and any applicable license terms for your edition of the software.

This license does not grant ownership of the software or any related intellectual property.

12. . Termination

We reserve the right to suspend, restrict, terminate, or revoke access to myke or associated licenses if these Terms are violated.

You may stop using myke at any time by uninstalling the software.

13. . Changes to These Terms

These Terms may be updated from time to time.

When changes are made:

• The “Last updated” date will be revised
• Updated Terms may be posted through the myke website, installer, or application
• Continued use of myke constitutes acceptance of the updated Terms
